4.18.2008 The IWSA Fact Sheet on State Renewable Statutes has been revised to include South Dakota, which passed an RPS that includes waste-to-energy as a renewable energy resource.

Rail-based waste processing facilities cannot operate free from state and local laws during FY2008, as a result of legislation signed into law by President Bush.  IWSA supports this and a permanent prohibition on siting unregulated rail-based transfer stations under a loophole in federal railroad law.

IWSA welcomes the Greater Detroit Resource Recovery Authority as its most recent Municipal member.  The GDRRA oversees Detroit's waste-to-energy facility, which generates clean renewable energy by processing 2,832 tons of trash per day.

The U.S. Supreme Court decided with a 6-3 majority that local flow control ordinances are constitutional if municipal solid waste is being directed to a publicly-owned waste facility.

Waste-to-energy can contribute to the reduction of greenhouse gases, according to the joint statement of 150 academics, policymakers, companies, and non-governmental organizations who have formed the Global Roundtable on Climate Change (GROCC).   The unveiling of the joint statement was the culmination of more than two years work to develop consensus on "The Path to Climate Sustainability."

The U.S. General Accountability Office (GAO) issued a new report recognizing that a long term extension of the renewable energy production tax credit, which includes waste-to-energy, is necessary to meet the nation's energy demands, reduce its economic and security vulnerability to foreign oil disruptions, and minimize adverse environmental effects.

54 House members and 42 Senators signed letters to President Bush urging him to include a five-year extension of the Section 45 renewable energy production tax creditwhich includes waste-to-energyin the Administration's FY 2008 budget request.

In the final hours of the 109th Congress, the House of Representatives and the Senate extended the Section 45 production tax credit for waste-to-energy and other renewable energy sources for an additional year.  When enacted, new facilities and units qualify for the credit if they are placed in service by  December 31, 2008.

A coalition of groups, including IWSA and the U.S. Conference of Mayors, call on lawmakers and policymakers to provide additional incentives to stimulate new waste-based energy capacity, and to support existing capacity.  Waste-based energy is a term used to describe all technologies that recover energy from waste.  The most prevalent examples of waste-based energy include waste-to-energy, landfill gas, and biomass.
